Terms of Use and License Agreement — IRBatch
Version: 1.0 · Effective date: 6 November 2026
These Terms of Use and License Agreement ("Terms") are between Aphex Coding, Bartłomiej Rakuzy Aphex Coding, Morska 139/6, 81-222 Gdynia, woj. pomorskie, Poland, tax ID (NIP) 8862855318 ("we", "us"), and you ("you"). If you accept these Terms on behalf of a company or other organization, "you" means that organization, and you confirm that you are authorized to bind it.
By using IRBatch at irbatch.aphexcoding.tech or activating a License Key you accept these Terms. If you do not accept them, do not use IRBatch.
Important — what IRBatch does and does not do
- Measurement data, no interpretation. IRBatch reads the raw thermal data and the parameters that the camera stored in a radiometric JPG file and converts them into temperatures using the standard radiometric formula. It does not assess buildings, electrical installations, equipment or anything else shown in your images, does not apply limits or thresholds, and does not tell you whether something is defective, safe or compliant. Any conclusions are yours.
- Not a measuring instrument and not a standard-compliant report. IRBatch is not a calibrated or certified measuring instrument. Its tables and reports are not designed to meet EN 13187, ASTM E1934 or any other standard, regulation or certification scheme. If your work must meet such requirements, you decide whether and how to use IRBatch for it.
- Results are only as accurate as your camera and the parameters. IRBatch cannot make results more accurate than the camera, its calibration and the parameters stored in the file or entered by you (such as emissivity, reflected temperature, distance and atmospheric conditions). If you enter your own emissivity or reflected temperature, all temperatures in that batch are recalculated with your values, and the report shows which values you changed.
- Not every file can be read. IRBatch reads radiometric JPG files from FLIR® cameras in the formats it supports. Some camera models and file variants are not supported; for such a file IRBatch shows a message and produces no result. Try before you buy: the free version reads your own file in the same way as the paid version.
- Do not rely on IRBatch alone for decisions about the safety of people or property. Check important readings with your camera or its manufacturer's software.
- Your files stay on your device. Your images are processed inside your web browser. They are not uploaded to us or to anyone else.
1. Definitions
- IRBatch — the web application available at irbatch.aphexcoding.tech, the program code that your browser downloads from that website and runs on your device, its updates and its documentation.
- Your Images — the image files you open in IRBatch, including the visual photos, measurement data and other information embedded in them, and the logo you add to a report.
- Output — the previews, tables, CSV files, ZIP files of temperature matrices and PDF reports that IRBatch creates from Your Images.
- Free Version — IRBatch used without an activated License Key.
- License — the paid right described in section 4, purchased for a one-time fee.
- License Key — the key you receive after buying a License.
- Activation — a browser on a device in which the License Key is currently activated. Each browser, browser profile and device counts separately.
- Consumer — a natural person who accepts these Terms for purposes outside their trade, business, craft or profession, and any other person whom the mandatory law of their country protects as a consumer in these Terms (in Poland this includes a sole trader for whom the Terms are not of a professional nature).
2. Free Version
IRBatch is offered free of charge. In the Free Version you can open one image at a time, see its thermal image and read its temperatures, without a time limit and without registration. Batch processing of several files, the summary CSV, the ZIP of temperature matrices and the PDF report require a License. You may use the results you see in the Free Version for any lawful purpose.
3. Ownership
IRBatch is licensed, not sold. We keep all rights, title and interest in IRBatch. You receive only the rights expressly granted in these Terms.
4. The paid License
Subject to these Terms and to payment of the fee, we grant you a non-exclusive, non-transferable license, without territorial limits, for the period described in section 7(c), to use the paid features of IRBatch: batch processing of many files, the summary CSV, the ZIP of temperature matrices and the PDF report with your title, logo and note.
a) No per-file fee. There is no limit on the number of images, batches or reports and no fee per file. The technical limits shown in IRBatch (such as the maximum number and size of files in one batch) apply.
b) Activations. You may activate one License Key in up to three (3) browsers or devices at a time. You may move an Activation by clicking Deactivate on this device and activating the key elsewhere. Clearing the website data of irbatch.aphexcoding.tech in your browser, or using a private window, removes the Activation from that browser without releasing it; deactivate first. If you can no longer deactivate (for example the device is lost or the browser data was cleared), write to us and we will release that Activation.
c) Who may use it. IRBatch with your License may be used by you and the members of your household, and, if you are an organization, by your employees and contractors, for your own purposes, including professional work such as preparing tables and reports for your clients.
d) No subscription. The fee is paid once. There are no recurring charges.
5. Activation and license checks
Activating a License Key requires an internet connection. The License is then stored in your browser's local storage for irbatch.aphexcoding.tech. While a License is active, IRBatch re-checks it with the license server about every 7 days when you open IRBatch and a connection is available; a missing connection never disables the License. If the License has been refunded, cancelled or charged back, or is no longer activated in that browser, IRBatch returns to the Free Version. The data sent during activation and checks is described in our Privacy Policy at https://irbatch.aphexcoding.tech/privacy.
6. Purchase, reseller and refunds
a) Who sells the License. Licenses are sold by Freemius, Inc. (USA), our authorized reseller and merchant of record. Your purchase contract is with Freemius: Freemius issues the invoice, collects payment and any applicable sales tax or VAT, and the terms Freemius presents at checkout apply to the purchase and payment. The price is shown at checkout.
b) These Terms and the Freemius terms. At checkout Freemius presents its own End User License Agreement (the "Freemius EULA"), under which Freemius is the seller. The Freemius EULA governs the purchase, payment, invoicing, refunds paid by Freemius and any dispute between you and Freemius. These Terms govern the license to use IRBatch and any dispute between you and us. The number of Activations in section 4(b) is the volume limitation specified at checkout for the purposes of the Freemius EULA. Nothing in the Freemius EULA reduces the rights these Terms give you against us.
c) 14-day guarantee. If the paid features do not work for you as described in these Terms — for example IRBatch cannot process in a batch the files that it reads in the Free Version, or cannot create the CSV, ZIP or PDF report in a supported browser — write to support@aphexcoding.tech or use the Freemius customer portal within 14 days of purchase. If we cannot solve the problem, you get a full refund of the amount you paid, including any tax charged at checkout. The refund is paid by Freemius. After a refund the License Key is cancelled and IRBatch returns to the Free Version. If Freemius cancels a purchase and refunds it, the License ends and section 5 applies.
d) Consumers. If you are a Consumer, your statutory rights — including any right of withdrawal and your rights if IRBatch does not conform to the contract — are not affected by these Terms. The guarantee in section 6(c) is given in addition to those rights.
7. Availability, updates and support
a) A web application. IRBatch runs in your browser but is delivered from our website. We may update it; your License works with all updates we publish. We are not obliged to provide new features. If you are a Consumer, we will provide the updates, including security updates, that the law requires to keep IRBatch in conformity with the contract.
b) Browsers and availability. IRBatch works in the current versions of the browsers listed on our website. We aim to keep the website available at all times, but short interruptions (for example for maintenance) can happen.
c) How long you can use your License. Your License has no end date. We will keep IRBatch available to License holders at least until the later of: (i) two years after the date of your purchase, and (ii) 90 days after we notify License holders by e-mail that we are going to stop offering IRBatch. If we stop offering IRBatch earlier than that, we will refund the amount you paid.
d) Support is provided by e-mail at support@aphexcoding.tech, in English or Polish, on a reasonable-efforts basis. There is no guaranteed response time, except that we answer complaints from Consumers within 14 days of receiving them. Please do not send us your images unless we ask for them; section 6 of our Privacy Policy explains why.
8. Restrictions
You must not:
a) modify, copy or redistribute the code of IRBatch in order to remove, bypass or disable the limits of the Free Version or the license check, or help others do so;
b) share, publish, sell, rent or sublicense a License Key, or activate it in more browsers or devices than allowed;
c) offer IRBatch, or a copy of its code, to others as your own service or website;
d) interfere with the website or overload it, for example with automated requests;
e) use IRBatch to break the law or to infringe the rights of others.
This section does not limit what the law allows you to do regardless of these Terms.
9. Your Images and the Output
a) Everything stays on your device. IRBatch processes Your Images only in your browser. We do not receive, upload or see them, nor the Output, the report title, the logo or the note you enter.
b) Your originals are not changed. IRBatch only reads the files you open. Output is saved only when you download it, to the place your browser or you choose.
c) The content of reports is yours. You decide what the report title, logo and note say. Each page of the PDF report carries a footer stating that the measurement data is provided as-is, without interpretation, and that IRBatch is not affiliated with Teledyne FLIR. If you add your own assessment to a report, or change or remove the footer, that content is your responsibility.
d) Your responsibility for the content. You are responsible for having the right to use Your Images and the logo in the way you use the Output, and for complying with the law with regard to personal data shown in or stored with Your Images (for example people, homes or location data). We are not a processor of that data.
e) The Output belongs to you, subject to the rights of others in Your Images. We claim no rights in it.
f) Check before you rely. The section "Important" at the beginning of these Terms describes the limits of IRBatch. Check the Output before you rely on it or give it to others.
10. Browser functions
IRBatch uses functions built into your web browser (for example for decompressing data and for saving files). They are not part of IRBatch and are governed by your browser's terms.
11. Trademarks and independence
IRBatch is an independent product of Aphex Coding. It is not affiliated with, sponsored or endorsed by Teledyne FLIR LLC or its affiliates. FLIR® is a registered trademark of Teledyne FLIR LLC; FLIR and the names of FLIR camera models are used only to describe the cameras and the files IRBatch reads. Other names are trademarks of their owners.
12. Freemius
These Terms are between you and us only. Freemius, Inc. is not a party to these Terms; its role is described in section 6.
13. Warranty
a) We will make reasonable efforts to keep IRBatch working as described in these Terms and on our website.
b) If you are not a Consumer: because the Free Version lets you test IRBatch on your own images before buying, and section 6(c) gives you a 14-day guarantee, IRBatch and the Output are otherwise provided "as is", without other warranties, express or implied, including merchantability, fitness for a particular purpose, accuracy and non-infringement, to the extent permitted by law.
c) If you are a Consumer, you keep all your statutory rights for digital content and digital services that do not conform to the contract; section 13(b) does not apply to you.
14. Limitation of liability
a) If you are not a Consumer, and to the extent permitted by law, we are not liable for indirect or consequential damages, lost profits, lost data, business interruption, or for decisions you or others make on the basis of the Output.
b) If you are not a Consumer, and to the extent permitted by law, our total liability under these Terms is limited to the amount you paid for the License, or USD 10 if you use only the Free Version.
c) If you are a Consumer, we are liable under the mandatory law of your country of residence, and sections 14(a) and 14(b) apply only to the extent that law allows.
d) Nothing in these Terms limits liability for damage caused intentionally or by gross negligence, for death or personal injury, under product liability law (including for destroyed or corrupted data that you do not use for professional purposes), or any other liability that cannot be limited under applicable law.
15. Term and termination
These Terms apply for as long as you use IRBatch. They end automatically if you materially breach them and do not cure the breach within 14 days after our notice; then you must stop using IRBatch and the License Key is cancelled. We will not terminate a paid License for any other reason; section 7(c) describes how long IRBatch stays available. Sections 3, 8, 9, 12, 14, 16 and 17 survive termination.
16. Export and sanctions
You must comply with export control and sanctions laws that apply to you. You may not use IRBatch if you are located in, or are a resident of, a country or region subject to comprehensive EU or US sanctions, or are on a sanctions list.
17. Governing law and disputes
These Terms and any dispute between you and us are governed by Polish law, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. If you are not a Consumer, disputes will be resolved by the court having jurisdiction over our registered place of business. If you are a Consumer, you also keep the protection of the mandatory laws of your country of residence and may bring proceedings in the courts of your country of residence. This section does not apply to disputes between you and Freemius, which are governed by the Freemius EULA.
18. Changes to these Terms
We may update these Terms, for example to reflect new features or changes in the law. Changes do not reduce the rights you have already paid for under a License without your consent. The current version is available at https://irbatch.aphexcoding.tech/terms, with its effective date.
19. Miscellaneous
If any provision is found unenforceable, the rest remains in effect. These Terms, together with our Privacy Policy, are the entire agreement between you and us about IRBatch. These Terms are available in English and in Polish (https://irbatch.aphexcoding.tech/pl/terms). For Consumers in Poland the Polish version is binding; if the versions differ, the version more favourable to the Consumer applies. In all other cases the English version prevails.
